Feb 15, 2016

HB 1368, which was recently voted down in the House, would require individuals who sell, purchase, or own a firearm to possess liability insurance. Read more about this issue. On January 30th, the LFDA decided to put the issue to its Facebook members, posting the question, “Should NH require firearms owners to carry liability insurance?”

“Should NH require firearms owners to carry liability insurance?”

Participation: 405 participants gave 1,480 responses

A total of 92% of those participating gave a 'yes or no' response to the question. The remaining 8% of participants engaged in the discussion but did not give a yes or no response. In total, the LFDA received 1480 responses from 405 individuals. (Click here for details on our methodology.)

What Participants Said:

No: A strong majority, at 96% of ‘yes or no’ respondents, opposed requiring the owners of firearms to carry liability insurance.

  • " Should rich people be the only ones who can afford to have a right? No.”
  • “Having insurance on guns is just another way to register and regulate.”
  • “You can't mandate insurance to exercise a constitutional right. It's no different than saying you have to carry slander insurance to exercise your right to free speech.”

Yes:  The minority of ‘yes or no’ respondents, at 4%, were in favor of a liability insurance requirement for firearms owners.

  • “Seems to make sense. In the news there is a lot of unintended discharges and there is no current law regarding proof of financial responsibility.”
  • “Yes, and gun owners should be prosecuted for accidental shootings even if the injured person is one of their own children… People should be made to understand that they will suffer even more for negligence.”

Other: As noted above, 8% of those participating did not give a yes or no response, instead addressing their comments to related questions and issues. These included:

  • Discussion of other insurance requirements: “Maybe we should mandate helmets, seat belts and car insurance first.”
  • Debating the disparity in impact of the proposal: “Will this impact low income families more?”
  • Questioning how the law would be implemented: “How are they going to know who has a gun?”
