Limited enforcement on use of mobile electronic devices while driving?

On February 18, the House Criminal Justice and Public Safety Committee will consider HB 1435, which would limit enforcement of the prohibition on the use of mobile electronic devices while driving to a secondary action when another offense is cited or charged.

As currently written, the amendment to RSA 265:79-c would read: "Enforcement of this section by law enforcement agencies shall be accomplished only as a secondary action when a driver of a motor vehicle has been cited or charged with a violation or some other offense."

Those in favor of HB1435 cite the importance of focusing on behaviors directly related to driving--speeding, reckless driving, etc. Those against the bill, however, say the use of mobile electronic devices while driving is a significant factor in many driving accidents today.

During the past 4 years, 116 fatal crashes in New Hampshire were caused by distraction.
